HIARCS Chess Software End-User License Agreement ("EULA") READ THIS AGREEMENT BEFORE INSTALLING OR USING THE SOFTWARE All the software, data and accompanying material in whatever form of the HIARCS Chess Software product hereafter collectively known as the Software is governed by this agreement including each and every component. BY INSTALLING, COPYING OR OTHERWISE USING THE SOFTWARE, YOU ARE AGREEING TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS EULA. IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT, PROMPTLY REMOVE ALL COPIES OF THE SOFTWARE FROM ALL YOUR ELECTRONIC DEVICES. 1. LIMITED USE LICENSE This Software is licensed, not sold. Applied Computer Concepts Limited grants you a non exclusive license to use the Software on any single device at one time provided that the software is only used personally by yourself. 2. OWNERSHIP AND COPYRIGHT The Software is owned by Applied Computer Concepts Limited and is protected by British Copyright Laws, international copyright treaties as well as other intellectual property laws and treaties. 3. RESTRICTIONS ON USE You may not rent, lease, distribute, sublicense or otherwise transfer the Software to any third party. You may not reverse engineer, translate, decompile, disassemble, modify, adapt or create derivative works of the Software. 4. COPYING RESTRICTIONS Unauthorised copying of the Software in whatever form is expressly forbidden except that you may make backup copies of the Software solely for backup purposes. 5. WARRANTY DISCLAIMER AND LIABILITY LIMITS The Software is supplied "as is" without any express or implied warranty of any kind including warranties of quality, performance, merchantability, or fitness for any particular purpose. In no event will Applied Computer Concepts Limited or its representatives be liable for any damages whatsoever including without limitation, damages for financial loss, loss of profits, business interruption, loss of information, direct, indirect, consequential or otherwise caused by any error or defect howsoever arising, or the use of or inability to use the Software even if Applied Computer Concepts Limited has been advised of the possibility of such damages. In any case liability shall be strictly limited to the amount of the License fee paid. This agreement is governed by the laws of England. Any dispute will be handled under the jurisdiction of an English Court.
